Welcome to 90Health, a mobile application provided by MDSafari Inc. D/B/A 90Health a corporation located at 360 Bloomfield Ave, Suite 301. By accessing or using our application (“App”), you (User) agree to be bound by these Terms of Use.
The App is available to individuals aged 13 years and older. By using the App, you represent that you are at least 13 years old and legally permitted to access the App in your jurisdiction.
Users may be required to create an account to access certain features. Accounts are anonymous; however, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. You are solely responsible for all activities under your account.
The App provides machine learning-driven object and sound detection tools to support individuals with psychotic disorders in engaging in reality testing. The App is intended for informational and supportive purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. You acknowledge that the App is not a medical device, does not establish a doctor-patient relationship, and should not be relied upon for health-related decisions. In case of a mental health crisis, contact emergency services or a licensed healthcare provider immediately.
We are committed to protecting your privacy and are HIPAA-compliant. Personal health information is stored and transmitted using industry-standard security measures. You acknowledge that no digital system is completely secure and agree to use the App at your own risk. We will never sell de-identified data. We may use collected data internally for research purposes to improve the App and related services.
You agree not to:
- Use the App in any unlawful manner.
- Attempt to reverse engineer, modify, or interfere with the App’s functionapty.
- Impersonate any person or misrepresent your identity.
- Upload any harmful or offensive content.
- Use the App for any purpose other than its intended use.
We reserve the right to suspend or terminate user accounts at our sole discretion for any violation of these Terms or misuse of the App.
All content, features, and functionality of the App are the exclusive property of MDSafari Inc. D/B/A 90Health. Users are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
The App is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or reliability of App outputs.
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the App. This includes but is not limited to damages related to emotional distress, misinterpretation of results, or loss of data.
You agree to indemnify, defend, and hold harmless MDSafari Inc. D/B/A 90Health, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of the App, violation of these Terms, or misuse of the App’s information.
We reserve the right to modify these Terms at any time. Changes will be communicated via in-app notifications or on our website. Continued use of the App after changes indicates your acceptance of the revised Terms. We may modify, suspend, or discontinue any part of the App at our sole discretion.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law principles.
